Terms and Conditions for ACH Advertising Application

1. Introduction

Welcome to ACH Advertising, a platform connecting buyers and sellers for vehicles. By accessing or using the ACH Advertising application (the "App"), you agree to these Terms and Conditions. If you do not agree with these terms, you must not use the App.IMPORTANT: ACH Advertising does not own any vehicles listed on our platform. We are strictly an advertising agency that facilitates connections between buyers and sellers. All vehicles are owned and sold directly by the sellers who list them on our app.

2. Eligibility & Access

• ACH Advertising is now an open marketplace. All users, including guests, can browse vehicle listings.• By default, seller information such as name, phone number, and profile photo is visible on listings. Registered users can also create accounts, upload vehicles, and send messages to other users.• Sellers who have completed the Know Your Customer (KYC) verification process have additional control over their privacy. Verified sellers may choose to hide their contact details from unverified users, ensuring that only KYC-verified buyers can access their information.• Responsibility for managing safety and privacy rests with each seller. ACH Advertising provides tools to support safer transactions, but sellers are solely responsible for deciding how much of their information to make visible to others on the platform.

3. User Accounts

• Open access: You can browse all vehicle listings without creating an account.• Registered accounts: Registration is required to create/manage listings, send and receive messages, save searches or vehicles, and use seller tools.• KYC verification (optional but recommended): Completing KYC unlocks additional controls and trust signals, including the ability for sellers to hide their contact details from unverified users and access higher usage limits.• Seller privacy controls: By default, seller contact details are visible. Verified sellers may choose to restrict visibility so only KYC-verified buyers can view their contact information.• Security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.• Enforcement: ACH Advertising may suspend or terminate accounts that violate these Terms, abuse the platform, or engage in fraudulent or unlawful activity.

4. Vehicle Listings

• Users can create, edit, and delete listings for vehicles for sale.• Listings must include accurate information about the vehicle, including but not limited to make, model, year, condition, and price.• Misleading or fraudulent listings are strictly prohibited and may result in account suspension.• ACH Advertising is not responsible for verifying the accuracy of vehicle listings and serves only as a platform for advertising these vehicles.

5. Platform Role and Limitations

• ACH Advertising is solely an advertising platform that connects vehicle sellers with potential buyers.• We do not: - Own any vehicles listed on the platform - Verify vehicle ownership or condition - Process or handle payments directly - Provide warranty or guarantee for any vehicles - Act as an agent for either buyers or sellers• All transactions and arrangements are made directly between buyers and sellers.

6. Listings Duration and Management

• Vehicle listings are free to post and remain active until marked as SOLD or removed by the seller.• Sellers may optionally purchase Boosts to increase visibility of their listings. Boost payments are one-time only and do not affect the base free listing.• Boosted listings are displayed with priority placement for the duration of the boost period, after which they revert to a regular free listing.• Accounts inactive for more than 90 days may be marked as dormant and require revalidation upon next login.• ACH Advertising reserves the right to remove inactive listings, expired boosts, or dormant accounts after providing notice to the user.

7. Payments, WiPay Integration, and Refunds

• ACH Advertising uses WiPay Trinidad for secure payment processing of TTD transactions.• All payments are processed through WiPay's secure hosted payment page.• Supported payment methods include local Trinidad and Tobago debit and credit cards.• Refund requests must be submitted within 48 hours of payment.• Refunds are processed through WiPay and may take 5-7 business days.• Payment disputes must be raised with WiPay directly through their dispute resolution process.• ACH Advertising will assist in facilitating communication between users and WiPay but cannot directly process refunds or resolve payment disputes.

8. Data Retention and Privacy

• User account information is retained for the duration of account activity plus 2 years.• Message history is stored for 1 year from the date of the last message.• Vehicle listing data is retained for 6 months after listing expiration.• Users can request data deletion, subject to legal retention requirements.• Payment transaction records are retained for 7 years as required by law.• ACH Advertising does not share or disclose any user's personal information with other users or third parties, unless required by law or with the explicit consent of the individual.

9. In-App Messaging

• The App provides messaging between all registered users. KYC verification is no longer required to send or receive messages.• Verified sellers may choose to restrict their contact details from non-verified users, including messaging.• Messaging must only be used for discussions related to vehicles listed on the platform.• Users must not use the messaging feature to share offensive, unlawful, or unsolicited content.• ACH Advertising reserves the right to monitor and review messages to ensure compliance with these Terms.

10. Dispute Resolution

• Any disputes between buyers and sellers should first be attempted to be resolved directly and amicably.• ACH Advertising is not a party to transactions and does not guarantee outcomes. We encourage users to exercise due diligence and take precautions during interactions.• ACH Advertising may, at its discretion, provide limited support or guidance to help resolve disputes, but ultimate responsibility rests with the buyer and seller.• For disputes related to paid boost services, users must contact ACH Advertising directly at support@achadvertising.com. Refunds or adjustments will be reviewed on a case-by-case basis.• ACH Advertising reserves the right to suspend accounts of users engaging in repeated, abusive, or unreasonable disputes.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Trinidad and Tobago. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.Users agree to submit to the jurisdiction of Trinidad and Tobago courts for any actions related to these Terms.

12. Intellectual Property

All content and materials in the App, including but not limited to text, graphics, logos, and software, are the property of ACH Advertising or its licensors. You may not reproduce, distribute, or modify any content without explicit permission.

13. Limitation of Liability

ACH Advertising is not responsible for:• Disputes or issues arising between buyers and sellers.• The accuracy of vehicle listings or seller information.• The condition, ownership, or legal status of listed vehicles.• Any loss or damage resulting from your use of the App or its content.• Any issues, errors, or disputes related to WiPay payment processing.• The outcome of any transactions between users.

14. User Responsibility and Safety

ACH Advertising provides an advertising platform only. We do not investigate, endorse, or guarantee any vehicle, listing, or user.While we use KYC verification and other tools to promote safety, ACH Advertising cannot prevent fraud or misrepresentation by third parties.By using the App, you agree that:• You are solely responsible for verifying vehicles, sellers, and transactions.• You must exercise caution when meeting in person, sharing personal details, or making payments.• ACH Advertising is not liable for scams, fraudulent transactions, loss of funds, or personal injury arising from use of the App.

15. Modification to the Terms

ACH Advertising may update these Terms from time to time. Changes will be effective upon posting in the App. Continued use of the App constitutes acceptance of the revised Terms.
